SPECIAL PRESENTATION:
OSU Airport Part 150 Noise Study Update - David Zoll
David Zoll, attorney and consultant, hired by the City to represent our interests in the Part 150 Noise Study process will share his analysis of the study process and inputs to date. See attached memorandum from David Zoll.
MINUTES:
1. Approval of Minutes
Recommendation: Approval of Minutes a and b as presented.
PUBLIC HEARINGS ON LEGISLATION:
2. ORDINANCE NO. 13-2008 – Appropriation – Law Enforcement Trust Fund
This Ordinance would appropriate funds from the Law Enforcement Trust Fund in the amount of $13,000.00 to provide for the purchase of radio equipment upgrades in the Communications Center.
Recommendation: Approval of the appropriation.
3. ORDINANCE NO. 14-2008 – Capital Improvement Fund
This Ordinance would appropriate funds from the Capital Improvement Fund to provide funding for the High Street Tree Restoration and Replacement project. This project was included in the 2008 Capital Improvement Program and was recommended by the Arbor Advisory Committee.
This Ordinance was introduced incomplete and the following amendments are necessary:
Section 1 - Sum of $10,000.00 (Ten Thousand Dollars)
Section 2 - The firms of Acorn Farms and Meticulous Landscaping
Recommendation: Approval of the Amended Appropriation Ordinance and proceeding with the project
4. ORDINANCE NO. 15-2008 – Health Inspection Program Requirements
This Ordinance would adopt Code provisions approving the health inspection program that was presented to City Council earlier this year by Columbus Public Health. The program utilizes different colors on placards to denote the inspection status of an establishment. Two public forums were held in the community regarding this proposal and the response was very positive.
The Central Ohio Restaurant Association and a local restaurant owner have indicated an intention to testify in favor of this legislation. Representatives of Columbus Public Health will be present to respond to questions Council may have. The legislation was prepared by the Director of Law.
Recommendation: Approval of the Ordinance to adopt the proposed health inspection program.
5. ORDINANCE NO. 16-2008 – Capital Improvement Fund
This Ordinance would appropriate additional funds from the Capital Improvement Fund in the amount of $3,906.00 to pay the Annual Debt Service associated with the OPWC Loan awarded for the ADA Handicap Ramp project.
Recommendation: Approval of this appropriation to commence the loan repayment.
6. ORDINANCE NO. 17-2008 – Change Zoning of Certain Land from I-2, General Industrial to I-1, Restricted Light Industrial (580 E. Granville Rd.)
This Zoning Change was initiated by the Municipal Planning Commission and involves the Storage Inns of America site. It appears that a rezoning was recommended when the site was developed but never enacted. This Ordinance would correct this oversight and ensure compliance of the current development.
Recommendation: Approval of the rezoning to bring the site into compliance with the provisions of the Planning and Zoning Code.
7. ORDINANCE NO. 18-2008 – Right-of-Way Agreement – Level 3 Communications
Level 3 Communications, LLC. based in Colorado has acquired the fiber facilities of ICG Communications, WilTel Communications Group and TelCove, Inc. All three of these firms operated telecommunications systems in Worthington and had right-of-way agreements with the City. This Ordinance would approve a Right-of-Way Agreement with Level 3 and replace the existing agreements. The agreements with ICG and Adelphia have expired and the WilTel agreement expires at the end of this year. Attached is the letter from Level 3 requesting an agreement with the City.
Recommendation: Approval of the Right-of-Way Permit for Level 3 Communications.
8. ORDINANCE NO. 19-2008 – Code Change – Amending Section 1101.03(d) of the Code to Update Traffic and Environmental Impact on Subdivisions
This Ordinance would incorporate further amendments to the subdivision regulations proposed by Council Member Norstrom and discussed by Council at the April 7th 2008 meeting. The purpose of these revisions were to clarify the language to reflect the intent of the legislation.
Recommendation: Approval of the amendments as presented in the Ordinance.
NEW LEGISLATION TO BE INTRODUCED:

9. Appropriation – Accrued Acreage Benefit Fund
This Ordinance would appropriate funds from the Accrued Acreage Benefit Fund in the amount of $65,000.00 to provide for Sewer System Capacity Charges due to the City of Columbus. This appropriation would provide for the increased activity we have experienced with sewer connections. The funds represent a pass through of what is collected with permits.
Recommendation: Introduce the Ordinance for public hearing on May 5.
10. Resolution – Right of Entry – Packard Annex
This Resolution would approve granting the Worthington Arts Council a right of entry to the Packard Annex in order to remove hazardous materials from the building to prepare for the development of the McConnell Arts Center. This was discussed with City Council at last Monday’s meeting as a part of the update on the Arts Center. The Right-of-Entry is limited in scope and was prepared by the Director of Law.
Recommendation: Approval of the Resolution granting the right-of-entry to conduct this work.

Department Quarterly Reports
Quarterly reports for the first quarter of 2008 are attached for Council’s review. If Council members have any questions, please feel free to contact the appropriate Department Director/Division Chief or myself. Last quarter, I stated a desire to implement changes in the reporting format. No changes have been implemented for this quarter; however, all of the quarterly reports will be placed on-line on the departmental web pages.
2008 Street Improvement Program
Attached is the proposed 2008 Street Improvement Program, a memorandum from the City Engineer and an administrative schedule for reviewing and considering the proposed program.
